Si no se present\u00f3 a su cita en el tribunal de inmigraci\u00f3n, probablemente haya recibido una orden de expulsi\u00f3n. Pero no se preocupe, esto no siempre significa que su caso haya terminado. En muchas situaciones, a\u00fan puede reabrir su caso y luchar contra la deportaci\u00f3n.<\/p>\n

\u00bfCu\u00e1ndo se puede reabrir un caso?<\/strong><\/h5>\n

Hay dos razones principales por las que el tribunal puede reabrir su caso:<\/p>\n

1.) Nunca se le notific\u00f3 debidamente<\/h6>\n

El gobierno debe notificarle oficialmente sobre su audiencia. Esto suele denominarse Notificaci\u00f3n de comparecencia (NTA). Debe incluir la fecha, la hora y el lugar de su audiencia.<\/p>\n

Podr\u00eda reunir los requisitos para reabrir si:<\/p>\n

    \n
  • En tu NTA faltaba la fecha, la hora o el lugar, y nunca recibiste ninguna notificaci\u00f3n posterior.<\/li>\n
  • El tribunal envi\u00f3 por correo su notificaci\u00f3n de audiencia a una direcci\u00f3n incorrecta.<\/li>\n
  • Realmente nunca recibi\u00f3 la notificaci\u00f3n.<\/li>\n<\/ul>\n

    \u00a0Importante:<\/strong> Si se mud\u00f3 y no le comunic\u00f3 su nueva direcci\u00f3n al tribunal, este seguir\u00e1 consider\u00e1ndole \u201cdebidamente notificado\u201d. Actualice siempre su direcci\u00f3n.<\/p>\n

    \u00a0Si nunca recibi\u00f3 la notificaci\u00f3n, puede presentar una Moci\u00f3n para reabrir el caso en cualquier momento. La deportaci\u00f3n se suspende autom\u00e1ticamente mientras el tribunal revisa su caso.<\/p>\n

    2.) Tuviste circunstancias excepcionales.<\/h6>\n

    Si recibi\u00f3 la notificaci\u00f3n pero no pudo asistir por motivos graves y ajenos a su voluntad, es posible que a\u00fan pueda reabrir el caso.<\/p>\n

    Algunos ejemplos de circunstancias excepcionales son:<\/p>\n

      \n
    • Una emergencia m\u00e9dica o una hospitalizaci\u00f3n.<\/li>\n
    • Fallecimiento de un familiar cercano (c\u00f3nyuge, hijo o padre).<\/li>\n
    • Violencia dom\u00e9stica o maltrato<\/li>\n
    • Malos consejos o errores de tu abogado<\/li>\n<\/ul>\n

      \u00a0Plazo:<\/strong> Debe presentar la solicitud dentro de los 180 d\u00edas siguientes a la orden de expulsi\u00f3n.<\/p>\n

      \u00bfQu\u00e9 pasar\u00eda si se enterara de la orden de expulsi\u00f3n a\u00f1os despu\u00e9s?<\/h5>\n

      A veces, las personas no saben que se les orden\u00f3 su expulsi\u00f3n hasta mucho m\u00e1s tarde. Por ejemplo, cuando solicitan una tarjeta de residencia o un permiso de trabajo.<\/p>\n

      En este caso, a\u00fan podr\u00eda presentar la demanda en virtud de una norma denominada \u00absuspensi\u00f3n equitativa\u00bb.<\/p>\n

      Esto significa que el plazo de 180 d\u00edas puede ampliarse si:<\/p>\n

        \n
      • No sab\u00edas nada del pedido por razones ajenas a tu voluntad, y<\/li>\n
      • Actuaste r\u00e1pidamente en cuanto te enteraste (por ejemplo, contratando a un nuevo abogado).<\/li>\n<\/ul>\n
        \u00bfQu\u00e9 debe hacer ahora?<\/h5>\n

        No acudir a la cita en la corte no tiene por qu\u00e9 ser el final de su proceso migratorio. Es posible que a\u00fan tenga opciones, pero debe actuar con rapidez.<\/p>\n

        \u00a0Medidas que se deben tomar de inmediato:<\/p>\n

          \n
        • Llame a un abogado con experiencia en inmigraci\u00f3n para ver si re\u00fane los requisitos para presentar una moci\u00f3n de reapertura.<\/li>\n
        • Aseg\u00farese de que su direcci\u00f3n est\u00e9 actualizada en el tribunal de inmigraci\u00f3n.<\/li>\n
        • Mant\u00e9ngase al tanto de su caso y no ignore las notificaciones.<\/li>\n<\/ul>\n
