But don\u2019t panic\u2014this does not always mean your case is over. In many situations, you may still be able to reopen your case and fight deportation.<\/p>\n<h5 class=\"p1\"><strong>When Can a Case Be Reopened?<\/strong><\/h5>\n<p class=\"p1\">There are two main reasons the court may reopen your case:<\/p>\n<h6>1.) You Never Got Proper Notice<\/h6>\n<p>The government must give you official notice of your hearing. This is usually called a Notice to Appear (NTA). It must include the date, time, and place of your hearing.<\/p>\n<p>You may qualify to reopen if:<\/p>\n<ul>\n<li>Your NTA was missing the date, time, or place\u2014and you never got a follow-up.<\/li>\n<li>The court mailed your hearing notice to the wrong address.<\/li>\n<li>You truly never received the notice at all.<\/li>\n<\/ul>\n<p class=\"p1\">\u00a0<strong>Important:<\/strong> If you moved and didn\u2019t tell the court your new address, the court will still consider you \u201cproperly notified.\u201d Always update your address.<\/p>\n<p class=\"p1\">\u00a0If you never got notice, you can file a Motion to Reopen at any time. Deportation is automatically paused while the court reviews your case.<\/p>\n<h6>2.) You Had Exceptional Circumstances<\/h6>\n<p>If you did receive notice but couldn\u2019t attend because of something serious and out of your control, you may still be able to reopen.<\/p>\n<p>Examples of exceptional circumstances include:<\/p>\n<ul>\n<li>A medical emergency or hospital stay<\/li>\n<li>Death of a close family member (spouse, child, or parent)<\/li>\n<li>Domestic violence or abuse<\/li>\n<li>Bad advice or mistakes from your lawyer<\/li>\n<\/ul>\n<p class=\"p1\"><strong>\u00a0Time limit:<\/strong> You must file within 180 days of the removal order.<\/p>\n<h5 class=\"p1\">What If You Learned About the Removal Order Years Later?<\/h5>\n<p class=\"p1\">Sometimes people don\u2019t know they were ordered removed until much later. For example, when they apply for a green card or work permit.<\/p>\n<p class=\"p1\">In this case, you may still be able to file under a rule called equitable tolling.<\/p>\n<p class=\"p1\">This means the 180-day deadline can be extended if:<\/p>\n<ul>\n<li class=\"p1\">You didn\u2019t know about the order for reasons outside your control, and<\/li>\n<li class=\"p1\">You acted quickly once you found out (for example, by hiring a new lawyer).<\/li>\n<\/ul>\n<h5 class=\"p1\">What Should You Do Now?<\/h5>\n<p class=\"p1\">Missing court doesn\u2019t have to be the end of your immigration journey. You may still have options\u2014but you must act fast.<\/p>\n<p class=\"p1\">\u00a0Steps to take immediately:<\/p>\n<ul>\n<li class=\"p1\">Call an experienced immigration lawyer to see if you qualify for a Motion to Reopen.<\/li>\n<li class=\"p1\">Make sure your address is updated with the immigration court.<\/li>\n<li class=\"p1\">Stay on top of your case and don\u2019t ignore notices.<\/li>\n<\/ul>\n<h5 class=\"p1\">Final Word<\/h5>\n<p class=\"p1\">A removal order can feel final, but in many cases it\u2019s not.
