It is available to individuals who:<\/p><ul><li aria-level=\"1\">Were trafficked for a <b>commercial sex act<\/b> induced by force, fraud, coercion\u2014or who were under 18 years of age at the time of the act<\/li><li aria-level=\"1\">Were trafficked for <b>labor or services<\/b> through force, fraud, or coercion, resulting in involuntary servitude, debt bondage, or slavery<\/li><\/ul><p>To qualify, you must also:<\/p><ul><li aria-level=\"1\">Be <b>physically present<\/b> in the United States as a result of trafficking<\/li><li aria-level=\"1\">Show that you would suffer <b>extreme hardship<\/b> involving unusual and severe harm if removed from the U.S.<\/li><li aria-level=\"1\">Cooperate with <b>law enforcement<\/b> in the investigation or prosecution of trafficking (this requirement is waived for minors under 18 or those unable to cooperate due to trauma)<\/li><li aria-level=\"1\">Be <b>admissible<\/b> to the U.S. or qualify for a <b>waiver of inadmissibility<\/b><b><br \/><\/b><\/li><\/ul><h3><span style=\"color: #eaa719;\"><b>What Protections and Benefits Does a T Visa Offer?<\/b><\/span><\/h3><p>T visa holders are granted <b>nonimmigrant status for up to four years<\/b>, with the possibility of extension. While in T status, you may:<\/p><ul><li aria-level=\"1\">Apply for a <b>work permit (EAD)<\/b> to live and work legally in the U.S.<\/li><li aria-level=\"1\">Apply for a <b>green card<\/b> (lawful permanent residency) after three years, or once the trafficking investigation or prosecution is complete<\/li><li aria-level=\"1\">Receive <b>public benefits<\/b> such as housing, food assistance, health care, education, and more\u2014without fear of being labeled a public charge<\/li><\/ul><h3><span style=\"color: #eaa719;\"><b>Derivative T Visas for Family Members<\/b><\/span><\/h3><p>T visa holders may also be able to bring certain family members to the U.S. through <b>derivative T visas<\/b>, including:<\/p><ul><li aria-level=\"1\">If you\u2019re under 21: your <b>spouse<\/b>, <b>children<\/b>, <b>parents<\/b>, and <b>unmarried minor siblings<\/b><b><br \/><\/b><\/li><li aria-level=\"1\">If you\u2019re 21 or older: your <b>spouse<\/b> and <b>children<\/b><b><br \/><\/b><\/li><li aria-level=\"1\">If your family members are at risk of retaliation because of your escape or cooperation, they may also qualify\u2014regardless of your age<\/li><\/ul><p>All qualifying family members can receive <b>work authorization<\/b> and access the same public benefits and services.<\/p><h3><span style=\"color: #eaa719;\"><b>What If You&#8217;re Not Eligible for a T Visa?<\/b><\/span><\/h3><p>If you do not meet the criteria for a T visa, you may still have options. One alternative is <b>Continued Presence (CP)<\/b>\u2014a form of temporary protection for victims who may serve as witnesses in trafficking cases. CP allows you to live and work legally in the U.S. without requiring active cooperation in an investigation. It is granted in one-year increments and can be renewed.<\/p><p>You may also qualify for a <b>U visa<\/b>, available to victims of other serious crimes (including trafficking), provided you meet specific cooperation and hardship criteria.
